从2013年的“虚拟商品”,到2017年的“虚拟货币”,再到近日中国央行副行长李波将比特币和稳定币定性为“加密资产”。由此可见,中国监管机构对比特币和稳定币的理解和认识在不断的升华和清晰。这也突显出比特币、稳定币等加密资产已经成为了全球科技和金融竞争的新关键领域。
在受访专家看来,在全球数字经济加速发展,且通胀预期持续升温的当下,比特币的价值储存功能已逐步成为一种“全球共识”。稳定币是重要的区块链技术应用之一,是一项前沿的金融科技,被认为具备全面变革全球支付体系的潜力。
不过,由于加密资产具备匿名性、国际流通性广等特征,在发展中暴露出市场操纵、欺诈、投资者保护不足、洗钱等问题。巴塞尔银行监管委员会发布的《虚拟资产审慎监管要求 (征求意见稿)》中,提出加密资产审慎监管框架要遵循一致性原则、“技术中立”原则、简单性原则和最低标准原则。
李波透露,正在研究对比特币、稳定币的监管规则,将来任何稳定币如果希望成为一个得到广泛使用的支付工具,必须接受像银行或准银行金融机构一样的严格监管。
从“虚拟商品”到“加密资产”
记者注意到,随着比特币和稳定币等“数字货币”在全球的发展,中国监管机构对比特币和稳定币的认识也在不断明晰。
在2013年底,中国央行等五部委在《关于防范比特币风险的通知》(简称《通知》)中,将比特币定性为“特定的虚拟商品”。
《通知》指出,比特币具有没有集中发行方、总量有限、使用不受地域限制和匿名性等四个主要特点。虽然比特币被称为“货币”,但由于其不是由货币当局发行,不具有法偿性与强制性等货币属性,并不是真正意义的货币。从性质上看,比特币应当是一种特定的虚拟商品,不具有与货币等同的法律地位,不能且不应作为货币在市场上流通使用。
彼时,《通知》明确,各金融机构和支付机构不得以比特币为产品或服务定价,不得买卖或作为中央对手买卖比特币,不得承保与比特币相关的保险业务或将比特币纳入保险责任范围,不得直接或间接为客户提供其他与比特币相关的服务,包括:为客户提供比特币登记、交易、清算、结算等服务;接受比特币或以比特币作为支付结算工具;开展比特币与人民币(6.4994, -0.0001, -0.00%)及外币的兑换服务;开展比特币的储存、托管、抵押等业务;发行与比特币相关的金融产品;将比特币作为信托、基金等投资的投资标的等。
到了2017年9月,中国央行等七部门在《关于防范代币发行融资风险的公告》(简称《公告》)中,强调融资主体通过代币的违规发售、流通,向投资者筹集比特币、以太币等所谓“虚拟货币”,本质上是一种未经批准非法公开融资的行为。代币发行融资中使用的代币或“虚拟货币”不由货币当局发行,不具有法偿性与强制性等货币属性,不具有与货币等同的法律地位,不能也不应作为货币在市场上流通使用。
近日,中国央行副行长李波在博鳌亚洲论坛2021年年会数字支付与数字货币分论坛上表示,比特币和稳定币是加密资产。加密资产是投资的选项,它本身不是货币,而是另类投资品。加密资产将来可能发挥的主要作用是作为一种投资工具或是替代性投资。
中国社会科学院金融研究所金融科技研究室主任尹振涛在接受《国际金融报》记者采访时指出,“从2013年的虚拟商品,到2017年的虚拟货币,再到今天的加密资产”,中国央行对比特币等“数字货币”的理解和认识在不断地升华和清晰,这不仅有利于监管执行和司法实践,更符合市场规律和发展趋势。
比特币作为投资品的价值
在全球数字经济加速发展且通胀预期持续升温的当下,比特币的价值储存功能已逐步成为一种“全球共识”。在中国通信工业协会区块链专委会轮值主席、火币大学校长于佳宁看来,比特币的关键价值主要可以体现在四个方面:
于佳宁告诉《国际金融报》记者,首先,挖矿机制是比特币价值的“基本盘”,挖矿过程中电力的消耗、矿机的折旧,源源不断为比特币网络输入价值,实现了物理世界的价值完成向数字世界的价值转化,构成了比特币价值基本盘。
其次,比特币总量2100万枚限定,目前已经“挖出”1868.6万枚,相当于近90%的比特币已经进入流通,目前的名义通胀率仅仅为1.75%,低于各国央行2%的普遍通胀目标。但是,由于丢失比特币私钥的事情时有发生,导致流通中的比特币也会随着各种原因减少,未来可能出现实质性的通缩,比特币的稀缺性进一步加剧,并将会从根本上影响价格的走势。
再次,比特币得到传统金融机构和上市公司的认可与参与,这成为了比特币价值捕获的关键一环。从2020年以来,全球最大资管公司贝莱德(BlackRock)、新加坡星展银行、俄罗斯联邦储蓄银行、纽约梅隆银行、高盛等顶级金融机构将开展加密资产交易和托管业务,特斯拉、PayPal、Square、微策略、美图公司等知名上市公司已经将比特币纳入核心资产配置,加拿大也陆续推出了多支基于实际资产的比特币ETF基金,在中国香港也推出100%锚定比特币的基金产品。
最后,于佳宁认为,比特币在数字世界中的地位,类似于美元在国际贸易中的地位。基于区块链的新兴应用正在蓬勃发展,未来十年以区块链为核心的数字技术的变迁,将成为整个世界发展的关键动力。而使用区块链的场景越多,对比特币的储备需求也就越大,对比特币价值毫无疑问也会产生巨大影响。
由于比特币已经成为了全球科技和金融竞争的新关键领域,各国政府都在加大对于该领域的监管关注和探索。从全球来看,美国、日本对比特币的监管走在了世界前列,英国、加拿大、澳大利亚、瑞士等国家也认可比特币的积极意义,正在着手制定相关的监管法规来规范行业发展。俄罗斯和泰国则由原来的禁止也转向了放松。
新加坡在区块链技术和加密资产领域的态度也愈发开放积极,鼓励在“监管沙盒”制度下的金融创新。新加坡在加密资产相关的法律法规制定走在行业前沿。
此外,在中国香港,香港证监会发布了加密资产新规,针对加密资产出台特定条款条件,由此平衡持有者利益保护、金融创新与金融稳定。
稳定币的发展前景
比特币之外,稳定币被认为具备全面变革全球支付体系的潜力。稳定币在发行时以法币或资产作为抵押,价值与某种法币锚定,以此实现价格的稳定,具备一定程度的货币属性,同时兼具区块链加密资产的技术优势,因此可以作为支付手段的可选项之一。
从2019年开始,诸如IBM、JP Morgan、Facebook、沃尔玛、高盛等商业巨头也都陆续宣布对于稳定币的探索。其中影响较大的包括在2019年6月Facebook牵头宣布的稳定币项目Diem(前身为Libra)以及JP Morgan在2019年2月推出的JPM Coin。在2021年1月,美国货币监理署发布公开信表示,美国国家银行和联邦储蓄协会可以使用公有区块链和稳定币进行结算。Visa在今年3月也宣布允许客户使用稳定币“USD Coin”(简称 “USDC”)在其支付网络上进行交易结算。
在Facebook宣布牵头推出Libra后,很多国家和国际组织都开始关注和研究稳定币的监管问题,并形成了一系列可借鉴的监管原则。
比如,G20成立的国际金融监管协调组织金融稳定理事会(Financial Stability Board,FSB)在2020年4月14日发布《应对全球稳定币带来的监管挑战 (征求意见稿)》,基于一致性原则和技术中立原则,提出了应对全球稳定币挑战的十项监管原则。
该征求意见稿提出,全球稳定币基本可以纳入现行监管规则框架,但需要具体问题具体分析,根据不同稳定币的运行机制和经济功能,厘清所应适用的具体规则和监管机构之间的职责划分;若还有监管空白,再考虑制定补充规定。
2020年11月24日,国际清算银行(BIS)发布工作报告《稳定币:风险、机遇和监管》,认为对稳定币的监管应建立在其可能提供诸多便利的基础上,而不局限于现有的监管框架,可以考虑实现 “嵌入式监管”,即直接将监管要求嵌入到“全球稳定币”系统的实现中。
除了国际监管组织的监管提议外,美国作为拥有最大规模的锚定法币稳定币国家,也对稳定币的运行提出了一系列的监管要求。2020年9月,美国货币监理署(OCC)发布指南称,美国联邦特许银行和联邦储蓄协会可以为稳定币发行商存储储备金。但仅允许银行为发行1:1锚定单一法定货币的稳定币发行商提供存储服务,另外银行至少每天都要验证储备账户余额始终等于或大于发行人未偿还的稳定币数量。
于佳宁指出,美国监管框架下的稳定币,仅适用于已获得监管部门审查通过并接受持续监管的稳定币,即已获得运营牌照的USDC、GUSD、PAX等。若要推动合规稳定币在全球范围内进行支付,仍需要国际社会的达成共识,并形成共同遵守的国际规则,因此更需要国际组织参与以及各国协调配合。
加密资产的风险和监管
加密资产带来了全新的商业模式,结合了新技术、新金融、新产业、新组织,这种更深层次的模式创新和过去的技术创新不一样,也对监管模式和风险管理提出了极大的挑战。目前,加密资产尚未对金融体系的稳定性造成实质影响,但发展中暴露出的市场操纵、欺诈、投资者保护不足、洗钱等问题已引起了各国监管机构的极度关注。
于佳宁介绍,比特币为代表的加密资产行业的市场风险、信用风险、操作风险仍然存在,技术风险突出。而近期大热的DeFi(分布式金融科技)则面临着更多诸如智能合约执行风险、操作安全性、清算风险和黑客攻击风险等更为复杂的技术问题。
此外,由于加密资产具备匿名性、国际流通性广等特征,因此近些年犯罪分子利用加密资产跨境兑换,将犯罪所得及收益转换成境外法定货币或者财产,已在一定程度上成为了洗钱犯罪新手段。
在中国,尽管监管机关明确禁止代币发行融资和兑换活动,但由于各个国家和地区对比特币等加密资产采取的监管政策存在差异,比特币和法币的交易可以通过境外加密资产服务商、交易所和比特币自动取款机等进行自由交易。
PeckShield发布的2020年年度数字货币反洗钱报告显示,2020年未受监管的出境加密资产价值达175亿美元,较2019年增长51%,且仍在快速增长。涉及加密资产的诈骗案件持续发生,达到151起,勒索类案件也快速增长。中国国内实施“断卡”行动,传统的洗钱途径遭遇沉重打击,继而转向加密资产,加密资产洗钱形式严峻。
随着加密资产和分布式金融科技DeFi等在全球范围内的迅速兴起和迭代,也引起了国际组织、各国央行和监管机构的广泛关注。目前来看,各国对加密资产相关金融活动的监管方式主要思路是,根据加密资产对应的业务本质进行分类,并将其纳入现行监管框架,明确所应适用的监管标准。
2020年8月7日,中国银行保险监督管理委员会发布题为《虚拟资产的国际监管思路及其对建立防范互联网金融风险长效机制的启示》的工作论文,论文中曾表示,可借鉴加密资产的国际监管思路和趋势,建立我国防范互联网金融风险的长效机制,避免重蹈网络借贷平台的覆辙。
根据巴塞尔银行监管委员会在2019年12月发布的《虚拟资产审慎监管要求 (征求意见稿)》,提出加密资产审慎监管框架可以遵循以下原则:
一是一致性原则。因为加密资产并未产生新的金融业务模式,只要是经济功能和风险本质相同的金融业务就应当适用同样的监管标准。
二是“技术中立” 原则,监管框架的设计不宜体现支持或反对某种特定技术方案的导向,但要考虑所采用的相关技术方案和其他特殊属性可能带来的额外风险。
三是简单性原则,银行目前的加密资产风险暴露仍然较小,应尽量根据其经济功能和业务本质,选用相对简单的 “标准法”。
四是最低标准原则,巴塞尔委员会提出的加密资产审慎监管框架仅为最低标准或监管底线,各国可以提出更为严格的监管要求。

Now, Joe Kovach, the engineer managing one of the debris sites in Tarpon Springs, Florida, where the box was found, is searching for its owner.
“Everyone has been basically dumping their entire lives onto the curb after the storm when everything flooded. My own boss’ house had 30 inches (of water) in it, and I saw his face and just how devastating it can be for everyone,” Kovach, an engineer with Pinellas County Public Works, told CNN.

“This was a needle in a haystack for sure. For something like that to survive all that when everything else was so wet and saturated, that was kind of incredible,” Kovach said.
Although the ring was found after Hurricane Milton, Kovach is sure the treasure was initially lost amid the ruins of Hurricane Helene, based on the pile of debris it came from, which Pinellas County Public Works tracks. It is likely the owner of the ring is from Crystal Beach, Ozona, or Palm Harbor, Kovach said.
On Tuesday, after the contractor informed him about the ring, Kovach posted a photo of the box and the note on several local community Facebook pages, asking if it belonged to anyone. He did not include a photo or description of the ring to ensure it is returned to the rightful owner who can accurately describe it. On the inside lid of the box is a gold engraving with the jewelry brand, “The Danbury Mint.”

“There are a lot of these medieval and ancient remains all around Europe, and they’re increasingly being studied using genomic methods.”
The findings not only shed fresh light on what Well-man looked like but also who he was, with a surprising twist about how he ended up in a Norse saga.
